Welcome to SPEC Toolbox, a structural design platform owned and operated by CLT Concepts Pty Ltd (SPEC Toolbox, we, us, our). This privacy policy (Policy) explains how we collect, use, and share your personal information when you access and use our platform and the services, features, content, and materials offered on our platform (Services).

Please read this Policy carefully before accessing or using the Services. By accessing or using the Services, you agree to the collection, use, and sharing of your personal information. Personal Information is information or an opinion about an individual, or an individual who is reasonably identifiable, whether true or not and whether recorded in material form or not. If you do not agree with our policies and practices, do not access or use the Services.

This Policy applies to all visitors, users, and others who access or use the Services (collectively, you). It also applies to information that we collect through any other means.

Purpose

The purpose for collecting personal information is to communicate with you about the platform, provide support, and send updates and promotional materials. This may include notifications about new features, updates to the platform, and special offers or discounts. By providing your contact information, you consent to receiving these communications from us.  

Types of Information Collected

This information is necessary for us to communicate with you and provide support for the platform. In addition to contact information, we also collect product analytics data. This data may include information such as project title, supplier chosen, and computation type.

The collected contact information and product analytics data will be used to communicate with you about the platform, provide support, and send updates and promotional materials. We may also collect personal information for purposes reasonably incidental to the aforementioned purposes. We may also use this data to understand your behaviour and preferences, identify trends and patterns, and identify opportunities for improvements to the platform. We may share this data with third parties, but only in anonymous or aggregated form and never in a way that personally identifies you. We will not sell or rent your personal information to third parties for their own marketing purposes without your express consent.

We may store collected information with a third party who may be located outside of Australia.

We will retain collected information for a minimum of 7 years.

As a user of the structural design platform, you have the right to access or correct your personal information at any time. You can exercise these rights by contacting us using the contact information provided below. 

You may also choose to opt-out of receiving updates and promotional materials by using the unsubscribe link provided in such communications or by contacting us directly. However, please note that opting out of certain communications may limit your ability to use the platform or receive support. 

We are committed to protecting your personal information and will make every reasonable effort to honour your request to exercise these rights in a timely manner. 

Data Security

We take reasonable measures to help protect your personal information from unauthorized access, use, or disclosure. However, no method of transmission over the internet or method of electronic storage is completely secure. We cannot guarantee the absolute security of your personal information.

We may update this privacy policy from time to time to reflect changes in our practices or to comply with legal requirements. When we make changes, we will post the updated policy on our website. We encourage you to review the privacy policy whenever you access the platform to stay informed about our information practices and your choices. 

Your continued use of the platform after the effective date of any changes to the privacy policy will constitute your acceptance of such changes.

Addendum A | GDPR

Application

This Addendum applies where:

  • you are located in the European Union;
  • we provide (or offer to provide) you with goods and services within the European Union; or
  • we otherwise process your Personal Data within the European Union.

(where one or more of the above apply, a GDPR Individual).

For the avoidance of doubt, if you are not a GDPR Individual, this Addendum does not apply.

Additional definitions

In this Addendum:

ePrivacy Directive means Directive 2002/58/EC of the European Parliament and of the Council of 12 July 2002 concerning the processing of personal data and the protection of privacy.

GDPR means the General Data Protection Regulation (EU) 2016/679.

Personal Data means:

  • Personal Information (as described in this Privacy Policy); and
  • any information relating to an identified or identifiable natural person who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

SPEC Toolbox is committed to complying with the GDPR and ePrivacy Directive in respect of Personal Data.

Data handling

As outlined in this Privacy Policy, we take reasonable measures to help protect your Personal Data from unauthorized access, use, or disclosure. We securely store your Personal Data at East Coast Data Centre USA (Heroku Services).

We will only keep your Personal Data for so long as is necessary to fulfil the purposes for which it was collected (as described at clause 3 [How It Will Be Used] of this Privacy Policy) or as otherwise permitted under the GDPR (Permitted Purposes).

We take reasonable measures to minimise the Personal Data which we collect, and strive to only collect Personal Data which is adequate, relevant and limited to what is necessary for the Permitted Purposes.

Where we transfer your Personal Data outside of the European Union, we will ensure that appropriate safeguards are put in place.

Your Rights

We wish to ensure that you are fully aware of your data protection rights under the GPDR.

Right to access: You have the right to seek confirmation as to whether your Personal Data is being processed, and certain other information in relation to any such processing. You have the right to request a copy of your Personal Data. We may charge you a reasonable fee for this service.

Right to rectification: You have the right to request that we correct any Personal Data you believe is inaccurate. You also have the right to request that we complete any Personal Data you believe is incomplete.

Right to erasure: You have the right to request that we erase your Personal Data, subject to certain limitations.

Right to restrict processing: Under certain circumstances, you have the right to request that we restrict the processing of your Personal Data. Please be aware that, where our Services (or particular aspects, features or functionality of the Services) depend or otherwise rely on the ability to process your Personal Data, such aspects may become unavailable or be of otherwise limited availability and functionality as a result of any such request.

Right to object to processing: Under certain circumstances, you have the right to object to processing of your Personal Data. As with the above, exercise of this right may result in certain Services becoming unavailable or of otherwise limited availability or functionality.

Right to data portability: Where technically feasible to do so, you have the right to request that we transfer your Personal Data to another controller.

We use a standard technology called ‘cookies’ our website and platform. Cookies are small text files placed on your mobile device or computer by our Website which automatically collect information about you without you providing that information to us directly.

We use cookies in a number of ways to improve your experience of our website, platform and the Services.
